Some Canadians have hired a London, Ont., based law firm to sue Samsung Electronics for negligence.
The class action lawsuit names both the U.S. and Canadian divisions of Samsung and was filed in Ontario Superior Court by McKenzie Lake Lawyers, LLP.
The claim alleges Samsung was negligent because the company knew or should have known that the devices could harm consumers.
The prosecution is seeking damages for clients who bought the Note 7, who say the defendants’ actions were false and misleading and contravened the Consumer Protection Act and the Competition Act.
Samsung Galaxy Note 7 phones were recalled worldwide last month following reports of overheating batteries that pose a fire hazard.
Hannah Shaheen of Burlington, Ont., and Daniel Fuller, a Michigan resident, are the plaintiffs in the case. The couple is looking to be compensated after they were forced to destroy and discard their Note 7 phones due to a ban from the air carrier. The pair were returning from a honeymoon on the Turks and Caicos Islands.
