A judge has decided that Caplansky’s deli can reopen “for now.”
Zane Caplansky was in court to fight a lease termination after his flagship store on College was suddenly shut down by the landlord earlier this week.
Caplansky says he found a foreclosure notice stuck to his restaurant’s door Tuesday.
It said the lease was terminated and the location seized due to “Failing to effect repairs not authorized by the landlord.”
The owner headed to court today in a bid to re-open his deli on College and Bathurst Street.
The judge says the case isn’t over though as the case will go to court at a later date.
The lawyer for the landlord said “this is a dispute over repairs to fire safety” but wouldn’t elaborate over what that meant. He said there is a dispute over whether Caplansky paid for fire equipment like sprinkers.
Caplansky was pleased as he left court and smiled and hugged his supporters.
