Judges are slowly striking down mandatory minimums but did an Ontario judge go too far on the crime of sexual interference with a minor?
A 50-year old man has been found guilty of sexual interference for fondling the breasts of a 15-year-old girl. Justice Maria Linhares de Sousa of the Ontario Superior Court of Justice gave the man a sentence of seven months in jail and two years’ probation. Justice de Sousa called the law that established the mandatory minimum for the offence unconstitutional, saying one year would be grossly excessive in “reasonable hypothetical” cases, although not in the one currently before her.
