An Air Canada Centre employee who was fired for stealing pop from the drink fountain has to be reinstated according to a labour arbitrator. The penalty of dismissal was apparently too harsh, and the wages lost from the 10 months after being fired is punishment enough.
The employee was using poutine cups to hold his drink. When the inventory count did not add up, the employee of five years was let go.
Does this qualify as theft? does he deserve his job back?
