Should Sgt. Dan Pravica be charged for tasering Sammy Yatim?
There are growing calls for a full review of the evidence that was presented during the case against James Forcillo, where the constable was found guilty of attempted murder after he fired multiple shots that killed the teenager on a Toronto streetcar in July 2013.
Multiple criminal lawyers, including Peter Rosenthal, believe that the sergeant should be charged with assault at the very least. He was the officer responsible for tasering Yatim after Forcillo had fired nine shots at the knife-wielding 18-year-old.
Rosenthal suggests that while Yatim lay on the floor he did not pose a danger, and therefore a Tasering was not justified.
Lawyer Daniel Brown told The Toronto Star that Pravica should face charges, but only under the Police Services Act.
